Shinzuu, my idea of tyranny is that if a large group of people are leaving, Khirch would rather have them killed then let them "work for" another Guardian...

Considering how dark you want to make Kin Chronicles be, if a tyranny is letting this many people leave, something happened to the command structure.

Khirch had been long killed, however, Elistro had already passed through that portion into Khirch's territory, and killed the border guards. However, you weren't supposed to know about that until later, but since you gotta argue about it, there you go. The darkness is only as much as you can find out from the actual story, and not assuming something else and trying to change the story because you're impatient.
